Terms & Conditions

Mystical Fairies trading as Mystical Fairies Parties Ltd has made every effort to word these terms and conditions in plain English, with clarification of various clauses where necessary. If you do not understand any part of these terms, please call us for clarification. Any booking whether confirmed verbally or electronically will be subject to a legally binding Contract carrying the following non-negotiable Terms & Conditions of Booking:

1. Definitions
   The booking Contract (“Contract”) is negotiated by Mystical Fairies (the Company’) and the Client (“Client “). A booking (“Booking”) is any verbal, electronic or written request securing entertainment/event planning and production for a specific date from the Client to the Company.
2. Confirming the Booking
   i) ‘Confirmation’ (“Confirmation”) will mean any verbal, electronic or written acceptance of this booking by BOTH the Client and the The Company .
   ii) All Bookings are confirmed and take effect immediately upon the agreed deposit being paid. iii) A deposit is due upon booking and any outstanding balance is due on the day of the event unless prior arrangements have been requested.

Upon ‘Confirmation’ of the Booking, Mystical Fairies will issue a confirmation email to the Client .

3. Changes to the Booking
   The agreed booking fees may be subject to change (in agreement with both the Client and the Company) if any details on the booking are altered. All changes to the booking must be arranged and agreed by Mystical Fairies in advance of the event.
4. Payment of fees
   The agreed fee is due upon booking unless special circumstances are agreed between Mystical Fairies and the Client. Fees can be paid by preferred payment method: BACS or credit/debit card. Booking deposits are refundable or can be transferred to alternative dates.

If any fee which the Client is due to pay prior to the event has not been received at least 1 working days before the event, the Company has the right to cancel the Booking without penalty.

5. Cancellations
   Cancellation by the Client:
   In the event that the Client cancels the Booking, the Client agrees to inform Mystical Fairies immediately. Deposit payments are fully refundable or transferable if the event can no longer proceed. COVID-19 We offer a flexible policy and if the events needs to be cancelled or changed we offer to refund the deposits or change to alternative dates.

Cancellation by the Company:
Cancellation by the Company is not allowed for any reason except circumstances covered by ‘Force Majeure’ (see clause 23.)

6. Late payment of fee/ deposit
   Failure by the Client to pay the booking fee / deposit within the terms specified may result in the booking may be cancelled.
7. Responsibility for incorrect information in the booking
   If your booking information is incorrect in any way, then it is your responsibility to inform us of any/all changes.
8. Complaints
   If through their own fault the Company is unable to fulfill part of the event schedule or breaks the terms of this Contract and the Client would like to claim a reduction on the fee, a complaint must be made in writing to Mystical Fairies no more than 30 days after the event. Full payment must still be made to the Mystical Fairies as agreed in the Contract. Withholding payment is illegal. Failure to pay the Company within the terms of this Contract will incur and may render the Client subject to prosecution.
9. Changes on the day
   Where possible, changes to the Contract schedule, which are unavoidable on the day of the event, should first be discussed & agreed with the Mystical Fairies.
10. Force Majeure
    In cases of ‘Force Majeure’ (which shall be known as war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, accident, civil commotion, national calamity, order of Government or Local Authority having jurisdiction in the matter, changes in law, foreign government policy, act of God), which are not attributable to any act or failure to take preventive action by the Artiste or Client, then the Artiste or Client may cancel this booking without penalty other than loss of payment already made.
